Ice Terms & Conditions
Ice™ is a new customer rewards programme, brought to you by The Ice Organisation Ltd.
To take part in Ice you must follow the terms and conditions set out below, which you should read carefully. These terms and conditions (including our Policies on Privacy and Data Protection and Cookies) apply to the collection and use of Ice points and set out the terms of the relationship between The Ice Organisation Ltd (“Ice") and each Collector.
1. Membership of Ice
1.1. To join Ice, you must register through the Ice website www.myice.com under your proper legal identity.
1.2. You are only eligible to join and continue to take part in Ice if:
a) you are over 18 years of age
b) you provide a resident UK, Channel Island or Isle of Man address
c) you provide Ice with a valid email address.
1.3. Changes of address and email address must be notified to us.
1.4. You must not be registered with Ice under any identity more than once without first terminating your current registration. You will not hold concurrently more than one Ice account under the same or different identities.
1.5. When you join Ice you agree to receive Ice service emails and Ice statements, which include your Ice points balance and other useful ways to collect and spend points.
1.6 We will send you other communications which may be offers on Ice points from our retailers joining the Ice programme and other ways to collect and spend Ice points. You will be given the opportunity to opt out of these communications.
2. Collecting Ice points
2.1. You can collect Ice points by purchasing goods and services from participating Partners which are available online, via the telephone, via email and in-store. To collect Ice points in respect of online purchases you must access the Partners website via www.myice.com in the first instance. Partners will retain their branded sites and all purchases will be made directly with the Partner. Some Partners will direct you to the relevant www.myice.com registration page as part of their own sites’ navigation.
2.2. Partners pay commission to us in respect of your “Approved Transactions”, for which we will credit you with Ice points as a reward. Some Partners will require you to make a successful application, which is subject to their terms and conditions before confirming it as an “Approved Transaction” qualifying for an Ice reward.
2.3. Approved Transactions are only those transactions that are tracked between us and the Partner, and made in accordance with these Rules, the terms of any Partners promotion and any other terms and conditions applicable. The Approved Transaction must be confirmed by the Partner as no longer capable of being cancelled by, credited to and/or refunded to you, whether in whole or in part.
2.4. Approved Transactions are not:
a) transactions where part of a query or an investigation has been initiated
b) transactions where data is required to enable Ice to be credited to your Ice account
c) transactions where data is corrupt, damaged or lost
d) transactions, which are or which Ice reasonably believe are conducted by you with a purpose, which is unethical and/or intended to obtain Ice points dishonestly.
2.5. When you complete an Approved Transaction, resulting in the payment of commission to Ice by a Partner then you will be entitled to Ice points as a reward in accordance with the terms of the Partner’s promotion. Unless otherwise specifically stated, the calculation of Ice points includes postage and delivery costs and the VAT element of the sale.
2.6. Ice points shall be owned by Ice and held in your Ice account when you register. Only Ice points obtained from Approved Transactions shall be credited to your Ice account.
2.7. You accept that in some cases there may be a delay or failure to credit Ice to your Ice account due to a Partner's failure to provide information to Ice. Whilst Ice shall use reasonable endeavours to recover Ice points for non-tracked transactions Ice shall have no responsibility or liability for such delay or failure.
2.8. Ice will use reasonable endeavours to ensure Ice is credited correctly. Ice is not responsible for incorrect information supplied by Partners.
2.9. Whilst most Partners report Approved Transaction immediately, Ice points will remain in a pending status until the Partner has reported to Ice that their returns period has expired, the returns period will vary by Partner and you should check each Partner for specific details.
2.10. In the event that you completed an Approved Transaction in full compliance with all associated conditions and Ice points are not showing or pending on your Ice account then in order to resolve this issue you must report a query of ‘missing transaction’. Ice will then attempt to recovery missing transactions associated with Ice points from the Partner. However, Ice makes no warranty or representation and offers no assurance or guarantee that the Ice will be credited to your account as a result. Ice cannot support a ‘missing transaction’ where the transaction occurred more than 90 days prior to notification to Ice.
2.11. Transactions that are marked with a pending status in your Ice Account are awaiting final confirmation from the Partner. This is an automatic process and Ice cannot expedite the process.
2.12. You are not entitled to Ice points in respect of Approved Transactions for which Ice does not receive the whole of the commission due from the Partner.
2.13. Where Ice has credited you with Ice points in respect of purchases that are subsequently reversed or cancelled by a Partner, Ice reserve the right to debit the value of that transaction from your Ice account.
2.14. Your failure to follow correctly any required instructions or conditions may result in no Ice points being credited to your Ice account for which you will have no recourse against Ice or Partners.
3. Your Ice account
3.1. You understand that regardless of the Partner through which you participate in Ice, you have a separate relationship with us. Your personal data will be controlled and processed by us as well as the Partners necessary for the purposes of performing our obligations and shall be shared by us with the Partner through which you participate whilst you are a participant in Ice.
3.2. You are required to use Ice points in an ethical manner and should your Ice account be used purposefully to defraud or inflate Ice earnings with Partners then duplicate transactions will be removed and/or your Ice Account subject to termination.
3.3. Ice is responsible for keeping your Ice account accurate and up-to-date in accordance with these Rules. Ice may adjust the balance of your Ice Account in respect of non-payment from Partners, refunds or returned products, suspected or actual dishonesty, and/or mistakes, including but not limited to, accounting errors.
3.4. You understand that running Ice can be technically complex, and that in the course of so doing information may be withheld, provided or received in good faith by any of the participants in it, which may lead to the balance of your Ice account being inaccurate from time to time. You and Ice will use reasonable endeavours to deal with and rectify Ice Account inaccuracies, and you agree that Ice shall have no liability to you or any third party in respect of them, including Ice’s inability to rectify errors to your satisfaction.
3.5. You shall contact Ice only in respect of your Ice account and in connection with any aspect of Ice points, whether for the purposes of raising a query, seeking further information or making a claim.
3.6. You shall contact the Partner in respect of the purchase, payment or delivery for any goods or services, whether for the purpose of query, seeking information or making a claim.
3.7. You are responsible for the security of your Ice points, and you agree that you will not transfer them to any other person unless specified by us, barter them for goods or services or deliberately or negligently enable any other person to obtain the benefit of Ice points awarded to you with or without your consent and that you will keep your Ice account details private.
3.8. You may view your Ice account through the Ice website (www.myice.com) with which you registered for Ice, you are responsible for keeping up to date the permanent record of the details of your Ice account including its current balance. It is possible that through events or reasons beyond Ice’s reasonable control Ice temporarily or permanently lose the data associated with your Ice account. You agree that we shall have no liability to you whatsoever in connection therewith.
3.9. In the event of a Partner terminating their partnership with Ice your Ice account will be unaffected. You understand that in this event, your communication in respect of Ice will remain with Ice.
3.10. One Ice point has a minimum discount value of £0.01, which can only be used against Approved Transactions. Ice may not in any circumstances be exchanged for cash.
3.11. Ice can only be used for discounts against Approved Transactions for a period up to three years from the date they are credited to your Ice account. Where you have made subsequent Approved Transactions in respect of which you have earned or used Ice, these will be deemed to have been used on a “first in first out” basis.
3.12. In the event that Ice points remain unused after a period of three years from the date they are credited to your Ice account, they will be deducted from the balance of your Ice account. We commit to invest the minimum value of the Ice so deducted in activities that will benefit the environment, for example by acquiring Emission Reduction Credits of equivalent value, within a period of twelve months.
3.13. In the event that your Ice account is closed you will automatically cease to be a participant in Ice. In the event that (i) you do not complete any Approved Transactions; and (ii) the balance on your Ice account does not change then your Ice account status will become ‘Dormant'. Unless we determine otherwise in our absolute discretion and on a case-by-case basis any unused Ice points that are three years old shall automatically be put to the benefit of the environment and your Ice account closed.
3.14. Ice may do any of the following at any time without cause or liability and without your consent: (i) close your Ice account; and/or (ii) amend, suspend or terminate Ice, any part of it or any feature within it; and/or (iii) restrict the hours of availability of Ice; and/or (iv) limit the amount of your permitted use of the Ice.
3.15. You acknowledge and agree that regardless of the size of the balance of your Ice account it may be automatically voided in any and all of the following circumstances:
a) if Ice or a Partner through whom you registered for the Ice should experience any event or process forming part of an insolvency, administration, receivership or winding up;
b) if for any reason, Ice should be unable to continue further funding of Ice, in whole or in part and whether as regards some or all participants in it;
c) Ice terminates your Ice account because of a breach or suspected breach of these Rules by you;
d) if you close your Ice account;
e) it is automatically closed as Dormant.
If Ice terminates your Ice account because of a breach by you of these Rules you agree that you will not seek to register with Ice again, whether using the same or a different identity to that under which you originally registered.
4.1. You agree that participation in Ice is at your sole risk.
4.2. You understand that your purchase of goods and/or services from Partners is subject to and governed by their terms and conditions of sale and not these Rules and that these Rules do not affect your statutory rights. Ice is not a party to the contractual relationship between you and the Partner.
4.3. Ice makes no warranty with regard to any goods and/or services obtained by you from Partners through Ice including representations, warranties, and fitness for purpose, merchantability or quality.
4.4. Vouchers purchased via Ice with Ice points are non-refundable and must be used within the given expiry period. You will always be given a minimum of one month from the date of purchase to use your voucher. Vouchers are non transferrable or redeemable for any form of Ice points, cash or credit alternative. In the event of any cancellation or refund the voucher part of your transaction is non-refundable.
4.5. You agree that Ice is provided on a strictly “As is” and “As available” basis. Ice makes no warranty that Ice will meet your requirements or that it will be uninterrupted, timely, or error free nor does Ice make any warranty as to the results that may be obtained from the use of Ice or as to its accuracy or reliability of any information obtained through it.
4.6. Ice shall not be responsible for any special indirect incidental; or consequential loss or damage or for any award or punitive or aggravated damages relating to your participation or inability to participate in Ice.
4.7. These Rules do not affect those of your statutory rights, which cannot be amended or excluded in law and the exclusions and limitations of liability contained in them shall be construed and applied accordingly.
4.8. You shall hold Ice, Ice’s Partners, officers and employees harmless from any claim, demand, expenses or damage relating to your breach of these Rules.
4.9. Ice’s failure to enforce your strict performance of any provision of these Rules will not constitute a waiver of Ice’s right to subsequently enforce such provision or any other provision of them.
4.10. Should you fail to comply with any of the above, your user rights are automatically terminated. This termination will be in addition to any criminal, civil or other remedies that Ice may seek.
4.11. These Rules shall be governed by and construed in accordance with the laws of England and Wales, whose courts shall have exclusive jurisdiction over any and all disputes arising out of or in connection with them.
